Article 1: Area of application
These conditions apply to every use of the website www.alcopaimmo.be (hereinafter to be referred to as ‘the website’), which is run by Abelim NV, with registered office at Pierstraat 231, 2550 Kontich, Belgium and company number 0446.232.464, irrespective of the origin of the data displayed on the website. 

Article 2: Nature of the statements
The various pages that the user consults on the website or that the user receives by means of interactive applications have a purely informative and indicative value. The content of the website and the data and links that appear on it may be amended, changed or supplemented at any time, without this being announced or any notification being given. 

Article 3: No offer
The placement of a premises or property on the website by no means implies a binding offer to sell or lease the property in question within the meaning of the Belgian Civil Code or to conclude any other agreement. An agreement is not therefore effected merely by accepting the price and the premises or property that is published on the website.

Neither the operator of the website nor the company from the Alcopa group from which the data originates or to whose goods or rights the data relates (hereinafter to be referred to jointly as "Alcopa") give any guarantee whatsoever regarding the up-to-dateness, accuracy, correctness, completeness or suitability for a specific purpose of the information, data or publications. Alcopa is not liable for any damage, expenses or losses of any kind that may be incurred as a result of the information, data or publications on the website. Alcopa is not liable for the extent to which its website is distributed by third parties and premises listed on it are distributed via internet service providers or via links to the website that are created by parties other than Abelim NV. Alcopa is not liable for any incompleteness, lack of clarity or incorrect information (e.g. price, area, description of the premises, specifications, ...) relating to the properties that are published on the website or relating to any other statement, publication or description on the website. Alcopa is not liable for any damage resulting from technical faults, interruptions to the access to this website or possible adverse interference with the user’s system or software. Alcopa is also not liable for any damage caused by possible viruses, bugs and similar, should these, despite precautionary measures having been taken, manifest themselves on the website. 

Article 5: Intellectual property rights
The user acknowledges that the information and data supplied and presented on the website are and remain the property of Abelim NV. The texts, drawings, photographs, images, data, trade and domain names, trademarks, logos and other elements are protected by intellectual property rights. The user is therefore not permitted to reproduce these texts, drawings, photographs, images, data, trade and domain names, trademarks, logos and other elements or to distribute them to the public, without first obtaining the explicit written consent of Abelim NV.

Article 6: Usage of the website that is not permitted
The user of this website undertakes, amongst other things: a. not to use the information presented on this website in an unlawful or illegal manner; b. not to use this website in such a way that the website is damaged, altered, interrupted or in any way made to be less efficient; c. not to use the website for the transmission or posting of computer viruses, or for the transmission or posting of illegal or unlawful material or material that is in any way inappropriate, including but not confined to material of a defamatory, obscene or threatening nature; d. not to use the website in such a way that the rights of a natural person, legal entity or association are infringed, including but not confined to privacy and intellectual property rights; e. not to use the website for posting or transmitting material for promotional or advertising purposes. Abelim NV reserves all rights to approach the user and/or to take the necessary measures if its own interests or those of third parties are damaged as a result of the above provisions being violated or by any other means. 

Article 7: Partial invalidity
If one of the clauses of these general terms and conditions proves to be invalid, this has no influence whatsoever on the legal validity of the other clauses.

Article 8: Applicable law and court of competent jurisdiction
If a dispute should arise relating to the use of the website or any data that is presented on it, Belgian law will apply exclusively. In the case of disputes that result from use of the website or any data that is presented on it, the courts of the judicial district of Antwerp will have exclusive jurisdiction. In the case of disputes that fall within the jurisdiction of the justice of the peace, the justice of the peace court of the eighth sub-district of Antwerp will have exclusive jurisdiction.
